You are required to familiarize yourself with the laws before riding an ATV, even if you are in another state. For this reason, the argument that you did not know is not an automatic defense in court.

It is also your responsibility to know where you are, and to be sure you do not enter someone else's property, regardless of how slight it may be.

However, the prosecutor and the judge have a lot of discretion. Although they are under no legal obligation to do so, they may take your explanation into consideration.
