is my four wheeler a lemon?

i bought it new at a dealer and one month afer i had it the plastic started to melt where the exhaust is i brought it in and they said it was a defect in the heat sheild and i would have to wait for a part upgrade it sould be ready in about two weeks its been six months now and i been calling every two weeks and they keep ttelling me two weeks would this fall under the lemon law how do i go about getting my seven thousand dollar bike fixed
