Default I want to buy an ATV but the owner said he stopped paying Honda. He showed me a statement where Honda said?

they only wanted the total balance paid. They did not try to collect the ATV. He hasn't or will not pay for that also. He has all the paperwork to prove that it was purchased ** him but not paid for. Will it be ok to purchase this ATV even though Honda never tried to repo it? I know I won't have a title.

No because if Honda decided that they want their ATV back they wont go after the guy that sold it to you they will come get it from you. You would lose on two counts, you wouldnt have the ATV and you wouldnt have the money. It sounds like this guy isnt trustworthy at all, so how hard would it be for him to take your money and a week later report the ATV stolen if Honda decided to play hard ball with him? Also, since you would have no title or paperwork other than this ATV that still belongs to Honda, your word wouldnt hold any water in court if Honda or this guy decided they wanted to come after you for it. My advice would be to walk away from this as it has bad news written all over it.

You will have to go with him to Honda (or the bank) and do a 3 way transaction. This way the day you pay is the day you get the title signed and released of any lien.

Don't just pay the guy and then think you will clear it with Honda later. That is just asking for trouble.
